Agreement to Terms

By accessing or using the Living Pono Project website (www.livingponoproject.org), participating in our programs, or engaging with our services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our website or services.


About Living Pono Project

Living Pono Project is a 501(c)(3) nonprofit organization based in Maui, Hawaiʻi. Our mission is to serve as a bridge for vulnerable populations—especially youth—into sustainable, culturally grounded food systems and career pathways rooted in Native Hawaiian values.


Use of Website

Permitted Use

You may use our website for lawful purposes, including:

  • Learning about our programs and mission
  • Making donations
  • Registering for programs and field trips
  • Accessing educational resources
  • Subscribing to our newsletter

Prohibited Use

You may not:

  • Use our website for illegal purposes
  • Attempt to gain unauthorized access to our systems
  • Interfere with website functionality
  • Harvest data or user information
  • Transmit viruses, malware, or harmful code
  • Impersonate Living Pono Project or our staff

  • Use our educational materials in classroom settings

Restrictions

Program Registration and Participation

Field Trips and Educational Programs

  • Registration is required for all programs
  • Program fees are $10 per student (Kupaʻaina Explorations)
  • Cancellation policies apply (see below)
  • Participants must follow safety guidelines and staff instructions
  • Parents/guardians must provide consent for minor participants
  • We reserve the right to refuse service or remove participants for disruptive behavior

Job Training and Employment Programs

  • Eligibility requirements apply
  • Participants must comply with program rules and attendance requirements
  • Living Pono Project reserves the right to terminate participation for violations of program policies

Donations

Tax Deductibility

Living Pono Project is a 501(c)(3) tax-exempt organization. Donations are tax-deductible to the extent allowed by law. We will provide a tax receipt for donations of $250 or more.

Donation Policy

  • All donations are final and non-refundable unless otherwise required by law
  • Donations are used to support our mission and programs
  • We do not provide goods or services in exchange for donations (except for designated campaigns like 100 for Hoapili)
  • Monthly recurring donations can be canceled at any time by contacting us

Payment Processing

Donations are processed through secure third-party payment processors. We do not store credit card information on our servers.


Cancellations and Refunds

Program Cancellations by Living Pono Project

If we cancel a program due to weather, staffing, or other circumstances, we will offer:

  • Full refund, or
  • Credit toward a future program

Participant Cancellations

  • Cancellations made 7+ days before the program: Full refund
  • Cancellations made 3-6 days before: 50% refund
  • Cancellations made less than 3 days before: No refund
  • No-shows: No refund

Liability and Assumption of Risk

Program Participation

Participation in Living Pono Project programs involves inherent risks, including but not limited to:

  • Outdoor activities on agricultural land
  • Physical activities (farming, hiking, cultural practices)
  • Interaction with plants, animals, and natural environments
  • Use of tools and equipment

By participating, you acknowledge these risks and agree that Living Pono Project is not liable for injuries, accidents, or losses except those caused by our gross negligence or willful misconduct.

Waiver

Parents/guardians of minor participants must sign a liability waiver before program participation.


Photography and Media Release

We may photograph or video record program activities for promotional, educational, or fundraising purposes. By participating in our programs or events, you consent to the use of your likeness in our marketing materials unless you opt out in writing.


Third-Party Services

Our website may integrate third-party services (payment processors, email platforms, social media). We are not responsible for the practices or content of these third parties. Your use of third-party services is subject to their terms and policies.


Disclaimer of Warranties

Our website and services are provided "as is" without warranties of any kind, express or implied. We do not guarantee:

  • Uninterrupted or error-free website operation
  • Accuracy or completeness of content
  • Results from program participation

Limitation of Liability

To the fullest extent permitted by law, Living Pono Project shall not be liable for:

  • Indirect, incidental, consequential, or punitive damages
  • Loss of profits, data, or business opportunities
  • Damages exceeding the amount you paid to us (if applicable)

Indemnification

You agree to indemnify and hold harmless Living Pono Project, its directors, employees, and volunteers from any claims, damages, or expenses arising from:

  • Your violation of these Terms
  • Your use of our website or services
  • Your participation in our programs

Governing Law

These Terms are governed by the laws of the State of Hawaiʻi, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Maui County, Hawaiʻi.

We may update these Terms at any time. Changes will be posted on this page with a new "Last Updated" date. Your continued use of our website or services constitutes acceptance of the modified Terms.


Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full effect.
